The ASA Georgia Chapter offers its members an online “Ask the Attorney” session which is presented by Ben Shapiro with Baker Donelson.  We offer this membership benefit to our members in the comfort of their office or in the field by using a smart phone or tablet.  We collect questions for Ben and then he presents the answers live online.   At each session Ben will not only address your questions but he will also discuss a hot topic affecting subcontractors.

Below are links to some of the archived sessions to give you the idea of what is presented.

 

March 26 – Topic discussed:  Most GC’s have the “no damages for delay clause” which entitles the sub to additional time and not additional money in the event of a schedule overrun. There are often overall project schedules as contract exhibits that depict definitive start dates and completion dates for various activities. If a project extends well beyond the completion date as shown on the contract schedule can the sub be entitled to additional monetary compensation in the light of the no damage for delay clause?

 

April 30 – Topics discussed:  Striking offset clauses between separate contracts with the same GC, negotiating better terms for retainage and new trends and the importance of striking OCIP’s (Owner Controlled Insurance Programs) and CCIP’s (Contractor Controlled Insurance Program) clauses.

 

October 29 – Topics discussed:   Review of the Court of Appeals of Georgia, Fifth Division in the case of ALA Construction Services, LLC v. Controlled Access, Inc.  What are some ways that Subcontractors can be proactive and protect themselves, but also not initiate a contentious relationship or conversations with the general contractors that we work for?”
